Zanya Medi-Spa & Aesthetics Terms of Service

By booking, attending, entering the premises, or receiving any service at Zanya Medi-Spa & Aesthetics ("the Spa"), you agree to these Terms of Service. Right of admission is reserved at the Spa's sole discretion.

 

These terms comply with South African law (including the Consumer Protection Act and POPIA).



1. Our Services

All treatments are aesthetic and cosmetic only. We do not provide medical diagnoses, medical advice, or medical treatments. Results vary from person to person depending on individual factors such as skin type, age, lifestyle, and health. No specific outcome is guaranteed.

 

We perform treatments according to professional standards and our clinical judgment. We reserve the right to refuse, modify, or discontinue any treatment at any time if we believe it is unsafe, unsuitable, or not in your best interest.



2. Your Responsibilities

You must:



  • Fully and honestly disclose all relevant medical conditions, medications, allergies, previous procedures, pregnancies, and lifestyle factors before any treatment.

 

  • Inform the therapist immediately if you feel any discomfort during treatment.

 

  • Strictly follow all aftercare instructions provided.

 

Failure to disclose information or follow aftercare may affect results and limits our liability. You agree to indemnify (protect) the Spa against any claim arising from your failure to provide accurate information. You are also responsible for completing any required consultation or consent forms before treatment.



3. Risks and Informed Consent

Aesthetic treatments carry inherent risks, including (but not limited to) redness, swelling, bruising, discomfort, pigmentation changes, scarring, infection, or unsatisfactory results. By proceeding, you voluntarily accept these risks and consent to the treatment.

 

We may take photographs or videos for your treatment records only. Any use of images for marketing or promotional purposes requires your separate written consent.



4. Appointments, Cancellations, and Late Arrivals

  • Appointments are subject to availability.

 

  • Please arrive at least 15 minutes early to complete any forms and prepare.

 

  • Late Arrivals: Arriving more than 10 minutes late may result in shortened treatment time or rescheduling. The full fee still applies.

 

  • Cancellations & Rescheduling: Requires at least 48 hours' notice. If you cancel or do not show with less than 48 hours' notice, or fail to attend, you will be charged the full treatment fee (or the applicable deposit/no-show fee). Deposits and no-show fees are non-refundable.

 

  • Cancellation policies, deposits, and fees are confirmed at the time of booking.

 

5. Payments, Packages, Vouchers, and Refunds

  • All prices are subject to change without notice.

 

  • Payment is due in full at the time of service (or as agreed at booking).

 

  • Completed treatments, started packages, and used services are non-refundable (except where required by law).

 

  • Packages & Prepaid Treatments: Non-transferable and non-refundable. They must be redeemed within one year of purchase. After one year, unused sessions will be credited to your client profile (no cash refund).

 

  • Vouchers: Valid for 3 years from the date of purchase, non-transferable, and cannot be redeemed for cash. Expired vouchers will be credited to your client profile.

 

  • If you do not complete a package, treatment, or voucher within the required timeframe, the Spa may cancel the balance with no refund.

 

6. Minors

Clients under 18 require written consent from a parent or legal guardian. We reserve the right to refuse treatment to any minor. No children under 13 are allowed in the Spa without parental supervision. If a minor accompanies you, they must remain in the treatment room with you at all times and follow our conduct rules (including our noise policy).



7. Client Conduct

Abusive, aggressive, disrespectful, or inappropriate behaviour toward staff or other clients will not be tolerated. The Spa may refuse service immediately and without refund.



8. Personal Belongings

The Spa is not responsible for any loss, theft, or damage to your personal items, clothing, jewellery, or valuables brought onto the premises. Please remove jewellery and valuables before treatment.



9. Privacy and Personal Information

We handle your personal information in accordance with the Protection of Personal Information Act (POPIA). Your data is used only for treatment, booking, payment, aftercare, and lawful business purposes.



10. Limitation of Liability

To the fullest extent permitted by South African law:



  • The Spa, its owners, employees, contractors, and agents are not liable for any indirect, consequential, or economic loss.

 

  • Our total liability for any claim is strictly limited to the amount you paid for the specific treatment that gave rise to the claim.

 

  • You agree that the Spa cannot be held liable for any injury, dissatisfaction with results, or loss of property.

 

Specialised Treatments and Therapist Availability

Zanya Medi-Spa & Aesthetics offers specialised aesthetic treatments that require specific machinery and highly trained therapists who have completed our strict training protocols.

 

In the event that a specialised therapist becomes unavailable due to dismissal, resignation, leave, illness, or any other reason, Zanya Spa reserves the right to:



  1. Postpone the affected treatment(s) until a suitably qualified replacement therapist is available who meets our training standards. In such cases, we may offer complimentary treatments to support your results. No refunds will be provided.

 

  1. Reassign you to another qualified therapist within the Zanya Spa team to complete your treatment or package. Please note that all treatments and packages are booked with Zanya Medi-Spa & Aesthetics as a whole, and are not tied to any specific therapist. No refunds will be provided in the event of a therapist change.

 

11. Force Majeure

The Spa is not liable for any failure or delay in providing services due to events beyond our reasonable control, including (but not limited to) acts of God, fire, flood, pandemic, government orders, strikes, or other unforeseen circumstances. In such cases, our obligations may be suspended or, if the event continues for more than 30 days, the affected services may be cancelled with no refund.



12. Amendments to These Terms

We may update or amend these Terms at any time. The version displayed on our premises or website at the time of your visit or booking applies. Continued use of our services after changes constitutes acceptance of the updated terms.



13. Governing Law

These Terms are governed by the laws of the Republic of South Africa.



14. Concerns and Complaints

If you are not satisfied with our service:



  1. Inform the receptionist on duty immediately.

We will address your query within 24–48 hours. Please include your name and contact number. Raising issues promptly through this process helps us resolve them fairly and is required before any formal claim.



15. General Provisions

These Terms constitute the entire agreement between you and the Spa. No verbal promises or representations outside these Terms are binding. If any part of these Terms is found invalid, the remaining provisions remain in full effect. Our failure to enforce any right does not mean we waive it.

 

By entering our premises or receiving treatment, you confirm that you have read, understood, and accepted these Terms of Service.
